Tax Deduction on Tax and Secretarial Fee 2022 (Revised)

IRB has issued the Revised Guidelines on Tax Deduction of Secretarial Fees and Tax Filing Fee from Year Assessment 2022 dated 17 August 2022

Key summary of the revised guideline is tabulated below :

01General Guideline

From YA 2000, the total tax deduction for secretarial & tax filing fees is limited to RM15,000.

T & C apply

1. Incurred and paid basis from YA 2020 (ie to be claimed tax deduction in the YA when the fees are paid)

Effective from YA 2022, T & C shall read

The incurred basis from YA 222 (ie to be claimed tax deduction in the YA when the fees are incurred)

02Tax Consideration

Treatment of fees incurred before YA 2020

Fee incurred before YA 2020 which have yet to be paid (which tax deduction has not been claimed), these fees are no longer deductible from YA 2022 onwards

Treatment of fees incurred during YA 2020 and YA 2021

Fees incurred during YA 2020 and YA 2021 which have yet to be paid (which tax deduction has not been claimed), these fee are deductible from YA 2022 onwards when the fees are paid

03Do you know :

• Out of pocket expenses are not allowable for tax deduction.
• Tax agent fee from approved tax agent under the Income Tax Act 1967 are only tax deductible
